ART. 214
ELEMENTS:
1. That the offender is a public officer;
2. That he takes advantage of his official position; and
3. That he commits any of the frauds or deceits enumerated
in art. 315 and 316. (estafa, swindling)
RTC has jurisdiction over the offense because the principal
penalty is disqualification.
